From the fileWhat catches people out with Form 2 Seller Disclosure Statement
Many sellers don't realise that failing to provide a compliant Form 2 before the contract is signed can give the buyer the right to terminate the contract and recover their deposit. Preparing the disclosure statement before your property goes to market helps avoid unnecessary delays and legal risk.
A Form 2 isn't a one-off document that can be prepared and forgotten. The information must be accurate and current when it's given to the buyer, so if anything changes before the contract is signed, the disclosure statement may need to be updated.
Some sellers assume the Form 2 replaces the contract of sale, but they're two separate documents. The Form 2 provides the buyer with mandatory property disclosures, while the contract of sale sets out the legal terms of the transaction.
A Form 2 requires information from a range of searches and records, including title details, registered interests, council and water information, planning details and, where applicable, body corporate records. Waiting until you've accepted an offer can delay the sale if these searches haven't already been completed.
