Transfer of Title

Transferring property between family members, following a relationship breakdown, or as part of an estate can be straightforward with the right help. Fixed fee, fully digital.

What's Involved

What we handle

  1. Transfer document preparation

We prepare all required transfer documents based on the nature of your transaction — family gift, relationship settlement, deceased estate, or commercial arrangement.

  2. Duty assessment

Transfer Duty may still apply to title transfers even between family members, depending on the state and the nature of the transaction. We confirm what applies upfront.

  3. Electronic lodgement

We lodge the transfer with the relevant state title registry electronically via PEXA or the appropriate state system.

  4. Confirmation

We confirm once the transfer has been registered and the title reflects the new ownership.

Real-world experience

  • Separation transfer with an existing mortgage

A couple came to us after separating. The family home was in one partner's name, and their settlement agreement required the other to be added to title. The property had an existing mortgage, and the lender needed to consent to any title change before we could proceed. We liaised with the lender directly, obtained consent, prepared the transfer documents, and lodged with the state registry. The whole matter was resolved in under three weeks. Neither party had to communicate with the other directly — all coordination went through us.

  • What catches people out with Transfer of Title

    1. Assuming no transfer duty applies because it's a family transaction. In most states, Transfer Duty can still apply to family transfers depending on the nature of the transaction and the state.

    2. Not understanding that title and mortgage are separate. You can add someone to a title without adding them to the mortgage, but your lender must be notified and must consent to the title change.

    3. Completing transfers informally without proper documentation. An unregistered title transfer creates significant legal and financial risk for both parties.
