Know the rules
What every QLD buyer and seller needs to know
QLD has its own rules. Here's what matters.
The agent prepares the contract
In Queensland, the contract of sale is typically prepared by the real estate agent using the standard REIQ form — not the conveyancer. Your Velora conveyancer reviews the contract in detail once prepared and advises you on anything that needs attention before you sign.
The Form 2 Disclosure Statement
Under Queensland's Property Law Act 2023, sellers must provide a Form 2 Disclosure Statement to buyers before the contract is signed. It discloses key information about the property including title details, encumbrances, and any matters affecting the land. Velora prepares this for sellers and reviews it carefully for buyers.
You have a 5 business day cooling off period
Buyers in Queensland have 5 business days after signing to withdraw from the contract. A penalty of 0.25% of the purchase price applies if cooling off is exercised. Cooling off does not apply to auction purchases.
Transfer Duty and first home buyer grants
Transfer Duty applies to most Queensland property purchases. First home buyers purchasing new homes may be eligible for a Transfer Duty concession and the First Home Owner Grant. Your Velora conveyancer will confirm what applies to your transaction.
Building and pest conditions
Standard REIQ contracts include conditions for building and pest inspections. Your Velora conveyancer will advise on these clauses, the timeframes involved, and what happens if issues are found.

Real-world experience
Scott's take on QLD conveyancing
"Queensland is the only state where the real estate agent prepares the contract. Buyers and sellers sometimes assume the contract has been reviewed by a lawyer. It hasn't. Reviewing it — and knowing what to look for — is exactly our job."

Undisclosed lease option, found before exchange
An investor purchasing a tenanted property in Brisbane assumed the existing lease would roll over to a periodic tenancy after expiry. The lease had an option for the tenant to renew — one the vendor hadn't disclosed on the property information form. We identified the option during lease review before exchange. The buyer went in with full knowledge and adjusted their yield calculations accordingly. No surprises after settlement.
From the fileBuilding condition deadline missed — nearly
A buyer in the Gold Coast came to us three days into their contract. The building and pest condition had a 14-day window they weren't aware of. Their inspection was booked for day 15. We flagged it immediately, the inspection was rescheduled, and the condition was satisfied within time. Missing that window would have made them unconditional — and the inspection found significant structural issues.
